By downloading, accessing, or using the Atom Fitness mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Teqtronic LLC ("Company," "we," "us," or "our").

You must be at least 13 years old (or 16 years old in the European Economic Area) to use this App. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18, you represent that you have your parent or guardian's permission to use the App and that they have read and agree to these Terms on your behalf.

3. Account Registration

3.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

• Maintain and update your information as needed

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

• Integration with Apple Health
• Food database search and barcode scanning
• Recipe creation and management
• Social sharing features
• AI-powered food photo analysis

5. Health and Medical Disclaimer

5.1 Not Medical Advice

THE APP IS NOT INTENDED TO PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The information provided through the App is for general informational and educational purposes only.

5.2 Consult Healthcare Providers

Before starting any diet, exercise program, or making changes to your health regimen, consult with a qualified healthcare professional. This is especially important if you have any medical conditions, injuries, or health concerns.

5.3 Nutritional Information

Nutritional data provided through the App comes from third-party sources (including FatSecret and Open Food Facts) and may contain inaccuracies. We do not guarantee the accuracy, completeness, or reliability of any nutritional information.

5.4 Exercise at Your Own Risk

You acknowledge that physical exercise involves inherent risks, including the risk of injury. You assume full responsibility for any risks, injuries, or damages that may result from your use of the App or participation in any exercise activities.

5.5 No Liability for Health Outcomes

We are not responsible for any health outcomes, weight changes, injuries, or other consequences resulting from your use of the App or reliance on information provided through the App.

6. User Content

6.1 Your Content

You retain ownership of any content you create or upload to the App, including workouts, recipes, meal logs, and profile information ("User Content").

6.2 License to Us

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your User Content solely for the purpose of operating and improving the App.

6.3 Content Guidelines

You agree not to submit User Content that:

• Is false, misleading, or deceptive
• Infringes on any third party's intellectual property rights
• Contains viruses, malware, or harmful code
• Is unlawful, harassing, defamatory, or obscene
• Violates any applicable laws or regulations

6.4 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.

7.3 Reporting Violations

The App integrates with third-party services including:

• FatSecret (food database)
• Open Food Facts (food database)
• Apple Health (health data sync)
• Spotify (playlist integration)
• Anthropic Claude (AI food analysis)

8.2 Third-Party Terms

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

8.3 Service Availability

We do not guarantee the availability or functionality of any third-party integrations. These services may change or become unavailable without notice.

9. Intellectual Property

9.1 Our Property

The App, including its design, features, content, and underlying technology, is owned by Teqtronic LLC and protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without our written consent
• Remove any copyright or proprietary notices
• Use automated systems (bots, scrapers) to access the App

10. Subscription and Payments

10.1 Free and Premium Features

The App may offer both free features and premium subscription features. Premium features require a paid subscription.

10.2 Payment Processing

Payments are processed through Apple App Store or Google Play Store. All purchases are subject to their respective terms and refund policies.

10.3 Subscription Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

10.4 Price Changes

We reserve the right to change subscription prices. Price changes will be communicated in advance and will apply to subsequent billing periods.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 No Guarantee of Availability

We do not guarantee that the App will be available at all times, uninterrupted, or error-free. We may modify, suspend, or discontinue the App at any time without notice.

12.3 Data Accuracy

We do not guarantee the accuracy, completeness, or reliability of any data, including nutritional information, exercise data, or health metrics.

13. Limitation of Liability

13.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEQTRONIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING FROM YOUR USE OF THE APP.

13.2 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13.3 Essential Purpose

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

14. Indemnification

You agree to indemnify, defend, and hold harmless Teqtronic LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third party's rights
• Any User Content you submit

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@atomfitness.com to attempt to resolve the issue informally.

15.2 Governing Law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles.

15.3 Arbitration Agreement

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters.

15.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending an email notification (for significant changes)

Your continued use of the App after changes take effect constitutes acceptance of the modified Terms.

17. Termination

17.1 By You

You may stop using the App and delete your account at any time.

17.2 By Us

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

17.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and dispute resolution.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Teqtronic LLC regarding the App.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

18.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
